Acceptable use policy

This policy sets out the conduct NivaxTel expects of people using the website, and of partners who later exchange wholesale voice or A2P SMS under an agreement.

The website

Do not misuse the site. In particular, do not:

• attempt to gain access to any non-public part of the hosting, the form endpoint or another person’s enquiry;
• send malware, or interfere with the availability of the site;
• scrape the site in a way that degrades it for others;
• treat published material as a confirmed rate or a confirmed capacity.

The enquiry form

Send information that is true to the best of your knowledge. Do not use the form for unsolicited bulk mail, for content that is unlawful, or for a message that impersonates another person. The hidden anti-automation field must be left empty. NivaxTel may ignore a submission that fails the human-verification check.

Voice and SMS, if a service is later agreed

The paragraphs in this section are to be confirmed before they are treated as conditions of a live service. If a written agreement for wholesale voice or wholesale A2P SMS is reached, the traffic sent under it would be expected to meet the following principles:

• It is lawful in the places it is sent from and sent to.
• The caller identity or the sender identity is not falsified.
• It is not unsolicited traffic of a kind the destination network or the applicable law prohibits.
• It is not artificially inflated, generated to manipulate a payment, or otherwise not genuine communications traffic.
• It stays within the destinations and the use described in the agreement.

What NivaxTel would do if traffic failed those principles — including whether it would be questioned, throttled or stopped — is to be confirmed in the agreement.

Consequences

Consequences for misuse of the website or of a future service are to be confirmed. This draft does not set a penalty and does not describe a suspension process as if it already existed.
