Draft, pending legal review. This text has been prepared for the website and has not been approved by counsel.
Terms of use
These terms cover use of the NivaxTel website.
The company
The site is operated by Nivax International Inc. (IBC 075009), 105 1st Floor, Waterside, Eden Island, Seychelles, trading as NivaxTel.
Information on the website
The website presents NivaxTel's wholesale voice and A2P SMS business for general information. It may be updated or withdrawn. Availability of the website is not warranted.
Services and agreements
A wholesale voice or A2P SMS service exists only under a separate written agreement. Sending an enquiry does not create that agreement. Destinations, prices and service conditions are set in the agreement.
The enquiry form
When the form is available, it may be used to send a genuine commercial enquiry. It may not be used to send unlawful content, to probe the site, or to submit automated messages. The form can be refused or left switched off. A successful submission delivers the message. It does not start the carriage of traffic.
Acceptable use
Use of the website, and any later service, is also covered by the acceptable use policy. That policy is a draft and is marked as such.
Intellectual property
The text of the website and the NivaxTel logo are used by Nivax International Inc.. You may read the pages and keep a copy for your own reference. You may not copy the logo or the pages into another commercial site, or present them as your own.
Liability
The wording of any limit on liability is to be confirmed. This draft does not set a cap, does not exclude a category of loss, and does not ask a visitor to accept a waiver. Commercial terms belong in a service agreement.
Governing law
The governing law and the venue for disputes are to be confirmed. This draft does not select a court and does not select a law.
Changes
These terms are a draft pending legal review. A later version replaces this one when it is published on this page. A change to the draft does not alter a written service agreement, which would stand on its own terms.
